Regeringen får meddela föreskrifter om
1. att det för vissa vattenverksamheter i stället för tillstånd ska krävas att verksamheterna har anmälts,
2. att tillsynsmyndigheten i vissa särskilt angivna situationer som omfattas av föreskrifter enligt punkt 1 ska förelägga den som har gjort en anmälan att ansöka om tillstånd,
3. när en anmälningspliktig verksamhet tidigast får påbörjas, och
4. att verksamheten inte får påbörjas innan tillsynsmyndigheten i ett beslut bedömt om den kan antas medföra en betydande miljöpåverkan.
Även om anmälningsplikt har föreskrivits får tillsynsmyndigheten, enligt föreskrifter som meddelas av regeringen, i det enskilda fallet förelägga en verksamhetsutövare att ansöka om tillstånd. Lag (2025:770).
