Bestämmelserna om distansförsäljning av varor i 7-11 §§ tillämpas inte på leveranser av varor som är föremål för mervärdesskatt i
1. Sverige enligt bestämmelser om vinstmarginalbeskattning i 20 kap., eller
2. ett annat EU-land enligt bestämmelser som i det landet motsvarar de särskilda ordningarna för begagnade varor, konstverk, samlarföremål och antikviteter i artiklarna 312-341 i mervärdesskattedirektivet.
