Varan är felaktig om näringsidkaren har låtit bli att lämna säkerhetsinformation om varan efter föreläggande enligt produktsäkerhetslagen (2004:451) eller låter bli att lämna sådan information om varans egenskaper eller användning som näringsidkaren enligt marknadsföringslagen (2008:486) har ålagts att lämna, om underlåtenheten kan antas ha inverkat på köpet.
Första stycket gäller också om föreläggandet eller åläggandet har meddelats varans tillverkare eller någon annan som i tidigare säljled tagit befattning med varan och näringsidkaren har känt till eller borde ha känt till att föreläggandet eller åläggandet inte har fullgjorts.
