Kan kollektivavtal som avses i 3 § inte träffas, får Arbetsmiljöverket medge avvikelse från 5, 6, 10 b och 12-14 §§ samt 15 § andra och tredje styckena, om det finns särskilda skäl för det.
Arbetsmiljöverkets beslut enligt denna paragraf får inte innebära att mindre förmånliga villkor ska tillämpas för arbetstagarna än som följer av Europaparlamentets och rådets direktiv 2003/88/EG. Lag (2011:740).
