• Artikel 4

  Due diligence statement before placing

  Relevant commodities may be placed, made available or exported only if they are deforestation free, produced in line with the law of the country of production, and covered by a due diligence statement. The statement is filed in the information system before placing, and means the operator assumes responsibility for compliance. Due diligence covers information gathering, risk assessment and risk mitigation.

  Example — A coffee importer files a statement per consignment referencing plot coordinates, harvest date and national land registry evidence before the container is declared to customs.

  Geolocation of every plot of land

  The operator must collect geolocation coordinates for every plot where the commodity was produced, using polygons above the stated size, together with production date or time range. The data must be linkable to the specific consignment and kept for five years. Without traceable geolocation the due diligence statement cannot be filed.

  Example — A tyre maker requires polygon data from 1,400 smallholder rubber plots and rejects two aggregators that can only supply village names without coordinates.
