Hyresnämndsmål
Hyresnämndsmål. Vid lägenhetsbyte ska tillstånd till byte, om hyresgästen eller den som hyresrätten ska överlåtas till har varit bosatt i sin lägenhet under kortare tid än ett år vid tidpunkten för ansökan om tillstånd, lämnas endast om det finns synnerliga skäl för bytet (12 kap. 35 § första stycket fjärde meningen jordabalken). En hyresgäst som visserligen bott i lägenheten men inte varit förstahandshyresgäst under ett år före ansökan har inte ansetts uppfylla bosättningskravet.
