En fastighet överläts genom gåva med villkor om att fastigheten inte fick försäljas så länge någon av gåvotagarna ville utnyttja fastigheten. En av gåvotagarna överlät genom gåva sin andel vidare. Villkoret har ansetts vara bindande mot gåvotagarens förvärvare och har därför utgjort hinder mot att på deras begäran bjuda ut fastigheten till försäljning på offentlig auktion enligt samäganderättslagen.
