Hyresnämndsmål
Hyresnämndsmål. När hyran fastställs enligt 4 § lagen om uthyrning av egen bostad ska den bestämmas till ett belopp som inte påtagligt överstiger kapitalkostnaden och driftskostnaderna för bostaden. Kapitalkostnaden beräknas som en skälig avkastningsränta på bostadens marknadsvärde utan koppling till bostadsägarens faktiska räntekostnader medan driftskostnaderna beräknas efter de faktiska kostnaderna. Hovrätten har funnit att hyran anses påtagligt högre än kostnaderna för bostaden om hyran överstiger kostnaderna med fem procent eller mer.
