Tillstånd till täktverksamhet avseende naturgrus ----- Miljödomstolen hade fastställt länsstyrelsens beslut att ge tillstånd till brytning av högst 70 000 ton naturgrus på en plats där det tidigare hade bedrivits täktverksamhet. Gruset skulle huvudsakligen användas för betongtillverkning. Miljööverdomstolen ansåg det visat att det är tekniskt möjligt att använda krossat berg istället för naturgrus som ballast i betong och konstaterade att en avsikt med den nya bestämmelsen i 9 kap. 6 b § miljöbalken är enligt propositionen att krossat berg i ökad utsträckning bör kunna ersätta naturgrus som ballast i betong. Miljööverdomstolen fann inte att bolaget hade visat att detta förfaringssätt skulle vara ekonomiskt orimligt. Ett skyddsavstånd till verksamheten på endast 100 meter till närmaste bostadshus gjorde också att verksamhetens lokalisering inte ansågs lämplig. Miljööverdomstolen avslog ansökan.
