Miljödomstolen avslog överklagandet
Beslut att lämna klagomål avseende rensning av dike utan åtgärd ----- Länsstyrelsen lämnade utan åtgärd fastighetsägares klagomål avseende att arbeten utförda i ett dike på fastigheten skulle ha varit en dikesfördjupning i stället för en rensning. Miljödomstolen avslog överklagandet. Miljööverdomstolen ansåg det visat att diket vid grävningen inte bara hade rensats och breddats utan även hade fördjupats. Därmed hade en tillståndspliktig markavvattning utförts. Miljööverdomstolen upphävde miljödomstolens dom och länsstyrelsens beslut och återförvisade målet till länsstyrelsen.
