Tillstånd till vindkraftverk ----- Länsstyrelsen gav tillstånd till uppförande och drift av två vindkraftverkpå en fastighet i Hjo kommun. Ett stort antal närboende överklagade och yrkade att tillståndsbeslutet skulle upphävas. Miljödomstolen avslog överklagandena. I miljööverdomstolen uppkom frågan om bestämmelsen i 16 kap. 4 § första stycket miljöbalken i dess lydelse efter den 1 augusti 2009, att kommunen ska tillstyrka vindkraftsanläggningar, var tillämplig i målet. Kommunens inställning i målet i Miljööverdomstolen var att den inte samtyckte till etableringen. Miljööverdomstolens majoritet fann att eftersom någon övergångsbestämmelse inte hade införts skulle den nya bestämmelsen tillämpas redan från ikraftträdandet, även om ansökningsförfarandet hade inletts dessförinnan. Miljödomstolens dom och länsstyrelsens beslut upphävdes därför.
