Miljödomstolen ansåg att det var tillräckligt att föreskriva försiktighetsmått och upphävde förbudet. Miljööverdomstolen fann att de anmälda åtgärderna riskerade att påverka havsstrandängen negativt och att denna påverkan inte kunde förhindras eller tillräckligt mildras av några försiktighetsmått. Det starka allmänna intresset av att bevara havsstrandängen ansågs överväga sommarstugeägarens intresse av åtgärderna. Miljööverdomstolen undanröjde därför miljödomstolens dom och fastställde länsstyrelsens beslut.
