Av föreningens stadga framgick att en privatperson som är medlem i en ansluten förening tillika är medlem i föreningen. Kravet i 16 kap. 13 § miljöbalken avseende att antalet medlemmarna skall vara lägst 2000 för att få överklaga, har föreningen inte ansetts uppfylla. Då föreningen inte heller hade rätt att överklaga som sakägare avvisade Miljööverdomstolen överklagandet.
