Tillstånd till produktion av träkol ----- Ett bolag hade under lång tid släppt ut kondensatvatten till en s.k. naturdamm. Vid tillståndsprövningen ansåg miljödomstolen att efterbehandling av dammen inte skulle omfattas av prövningen utan skulle tas upp av tillsynsmyndigheten med stöd av bestämmelserna i 10 kap. miljöbalken. Miljööverdomstolen fann däremot att frågan om efterbehandling av dammen borde avgöras inom ramen för den aktuella tillståndprövningen. Varken det faktum att utsläppen till dammen skulle komma att upphöra eller att dammen förorenats även av andra verksamhetsutövare gav anledning till annan bedömning. Efterbehandlingsfrågan sköts upp under en prövotid.
