Miljööverdomstolen (MÖD) fann att behovet av matjord i första hand bör täckas genom sådan jord som blir tillgänglig vid anläggningsarbeten samt genom tillverkad jord. Om det skulle visa sig att efterfrågan på matjord inte kan tillgodoses skall behovet av matjord vägas mot intresset av att bibehålla jordbruksmarken. Då någon behovsutredning inte förelåg fann MÖD det inte visat att ingreppen i miljön skulle stå i rimlig proportion till nyttan av täkten.
