Avgift för prövning och tillsyn ----- En kommunal nämnd hade tagit ut tillsynsavgift efter det att Vägverket inkommit med anmälan om uppläggning av inerta massor (SNI-kod 90.007-2) som uppkommit vid dikning. Vägverket överklagade tillsynsavgiften och åberopade att massorna vid provtagning visat sig vara utan förorening varför anmälan varit onödig och avgift inte bort tagits ut. Miljööverdomstolen fann att nämnden inte hade haft anledning att utgå från annat än att anmälan avsåg inert avfall för anläggningsändamål där föroreningsrisken var ringa. Vid sådant förhållande har nämnden rätt att ta ut avgift för sin tillsynsinsats även om det i efterhand skulle framkomma att inte ens ringa föroreningsrisk funnits.
