Inhibition m.m. ----- Försvarsmakten hade ansökt om tillstånd till militär verksamhet vid Malmens flygplats i Linköpings kommun. Miljödomstolen hade genom det överklagade beslutet prövat ett inhibitionsyrkande, framställt av Försvarsmakten, trots att ärendet enligt 21 kap. 7 § miljöbalken skulle överlämnas till regeringen för avgörande. Miljööverdomstolen (MÖD) undanröjde beslutet och återförvisade frågan om inhibition till miljödomstolen för fortsatt handläggning. I skälen anförde MÖD att miljödomstolen inte var behörig att slutligt avgöra målet och då inte heller kunde anses behörig att meddela inhibition eller i övrigt förordna rörande saken.
