Efter överklagande från bolaget upphävde miljödomstolen villkoret
Villkor för tillstånd till fortsatt grustäkt ----- Länsstyrelsen hade satt upp som villkor i ett täkttillstånd att arbetsmaskinerna skulle vara försedda med skyddsplåt/bukplåt för att undvika oljespill i täktområdet. Efter överklagande från bolaget upphävde miljödomstolen villkoret. Miljööverdomstolen fann däremot att ett villkor mot sådant spill var motiverat. Det borde emellertid formuleras så att verksamhetsutövaren kunde välja att montera spillplåt på arbetsmaskinerna eller ställa upp dem på plåtar för uppsamling av oljespill eller placera dem på hårdgjord yta med motsvarande funktion. Villkoret omformulerades i överensstämmelse med detta.
