Miljödomstolen avvisade överklagandet
Rätt för en kommun att överklaga beslut rörande dispens från strandskyddsreglerna ----- En kommun överklagade ett beslut av länsstyrelsen att medge strandskyddsdispens för uppförande av bostadshus. Miljödomstolen avvisade överklagandet. Miljööverdomstolen uttalade emellertid att kommuner tillerkänts klagorätt i praxis enligt naturvårdslagen med hänvisning till att naturvården är en statlig såväl som en kommunal angelägenhet (jfr. RÅ 1996 ref. 39). Eftersom någon ändring inte var avsedd genom införandet av miljöbalken medgavs kommunen klagorätt.
