Miljööverdomstolen (MÖD) ansåg att skrivningen i 4 § första stycket i förordningen om bygde- och fiskeavgifter enbart uteslöt bidrag i de fall som skadereglering skett genom att ersättning tidigare betalats för samma skada. Då det var fråga om en fortlöpande skada ansåg MÖD att bidrag skall kunna utgå flera gånger för att reparera fastigheten och skydda den mot fortsatt skada.
