Miljödomstolen meddelade villkor dels för avledandet, dels för utsläppet av blandat process- och grundvatten i recipienten
Tillstånd att leda bort inläckande grundvatten från tunnel ----- Banverket hade ansökt om tillstånd enligt 11 kap. miljöbalken för avledning och bortledning av grundvatten i samband med tunneldrivning. Miljödomstolen meddelade villkor dels för avledandet, dels för utsläppet av blandat process- och grundvatten i recipienten. Miljööverdomstolen (MÖD) ansåg däremot att tillståndsprövningen endast kunde omfatta själva vattenverksamheten, dvs. bortledandet av grundvatten. Domstolen fann nämligen att förutsättningar saknades att utan ansökan från Banverket pröva den miljöfarliga verksamheten som tunneldrivningen utgjorde eller de utsläpp och olägenheter som tunneldrivningen skulle kunna förorsaka. Den miljöfarliga verksamheten fick i istället regleras med stöd av bestämmelserna om tillsyn i 26 kap. miljöbalken. Miljööverdomstolen upphävde därför utsläppsvillkoren för avloppsvatten.
