Föreläggande om anslutning till avloppsanläggning ----- En fastighetsägare förelades vid vite att ansluta sitt avlopp till en privat gemensam avloppsanläggning som drevs av en förening. Eftersom anslutningskostnaden var osäker och samverkan i föreningen byggde på frivillighet fann miljödomstolen att föreläggandet skulle upphävas. Miljööverdomstolen delade denna bedömning och tillade att tillsynsmyndigheten hade möjlighet att med ett föreläggande förbjuda utsläppet av BDT-vatten enligt 40 § och 7 § miljöskyddslagen och även förena föreläggandet med vite om inte fastighetsägaren dessförinnan visat att det var uppenbart att olägenhet inte skulle uppkomma.
