Sedan en fastställelsetalan väckts återkallade käranden sin talan. Motparten yrkade då att målet skulle prövas i sak enligt 13 kap. 5 § rättegångsbalken. Fråga uppkom om det fortfarande var av avgörande betydelse att få fastställelsetalan prövad. Arbetsdomstolen finner att så inte är fallet och avvisar talan.
