Om avhjälpande eller omleverans inte kommer i fråga eller inte sker inom skälig tid efter reklamationen, får köparen kräva prisavdrag beräknat enligt 38 § eller häva köpet enligt 39 §.
Köparen har dock inte rätt till prisavdrag vid köp av begagnade varor på auktion.
