En man förs bort i en bil, misshandlas och krävs på pengar. I målet mot två av männen i bilen och två män som åtalats för anstiftan till utpressning uppstår bl.a. dels frågan om målsäganden utsatts för ett människorov och om det i så fall skall bedömas som mindre grovt samt dels frågan om gärningsmännen handlat gemensamt och i samförstånd. Vid bevisvärderingen har en tilltalads vägran att svara på frågor ("the right to silence") inte tillagts bevisvärde samt ett antal s.k. kringomständigheter inte ansetts tillräckliga för att åtalet för anstiftansbrott skall anses styrkt. Även fråga om tillämpning av 29 kap. 4 § brottsbalken.
