Hyresnämndsmål
Hyresnämndsmål. I syfte att få tillstånd att hyra ut lägenheten i andra hand har en hyresgäst vilselett hyresvärden beträffande andrahandshyrans storlek genom att visa upp kontrakt med betydligt lägre hyra än han enligt i övrigt likalydande kontrakt tagit ut av andrahandshyresgästerna. Det har, vid tillämpning av 12 kap. 46 § första stycket 2 jordabalken, ansetts som ett åsidosättande av hyresgästens förpliktelser att lämna hyresvärden oriktiga uppgifter beträffande förhållanden som är av betydelse för hyresförhållandet.
