Reformatio in pejus? En 20-årig man överklagade ensam två skilda tingsrättsdomar i vilka som påföljd valts, i det första fallet s.k. fortsatt skyddstillsyn jämte fängelse två månader enligt 28 kap. 3 § brottsbalken och, i det andra fallet, 14 dagars fängelse. Hovrätten upphävde påföljdsbestämningarna och förordnade i stället att den mannen tidigare ådömda skyddstillsynen skulle avse brotten i de båda överklagade domarna i kombination med behandling enligt en särskild behandlingsplan. Vid bestämmande av alternativstraffet fann sig hovrätten oförhindrad att bestämma detta utifrån brottens straffvärde vilket innebar sex månaders fängelse.
