Vid en ansökan om lagfart ingavs både ett bodelningsavtal och ett köpebrev enligt vilka en kvinna förvärvade sin tidigare sammanboendes del i en gemensamt förvärvad fastighet. Inskrivningsmyndigheten fastställde stämpelskatt som för köp. Hovrätten fann att fastigheten inte varit sambornas permanentbostad och därför inte kunde ingå i en bodelning. Förvärvet var därmed stämpelskattepliktigt som köp.
