I mål om lönediskriminering uppkommer vid prövningen huruvida arbetsgivaren tillämpat lägre lön för vissa arbetstagare än för en annan arbetstagare fråga huruvida ersättning för obekväm arbetstid och värdet av arbetstidsförkortning skall ingå i underlaget för lönejämförelsen. Arbetsdomstolen har beslutat att enligt artikel 177 i Romfördraget inhämta EG-domstolens förhandsavgörande i frågan.
