Sustainability in EU law

The sustainability rules connect in three steps: the taxonomy defines what counts, reporting requires it to be disclosed, and due diligence requires something to be done about what is disclosed. This page takes the steps one at a time.

Reporting

  • The duty follows size and listing status, phased in over several years.
  • Disclosure must cover both how the business affects the world and how the world affects the business.

The taxonomy

  • An activity counts as sustainable when it contributes substantially to one objective without harming the others.
  • Minimum safeguards apply even where the technical criteria are met.
  • The share of taxonomy-aligned turnover, capital expenditure and operating expenditure is disclosed.

Due diligence

  • The duty covers own operations, subsidiaries and parts of the chain of activities.
  • Risks must be identified, prevented and followed up, not merely described.
  • The climate transition plan is part of the requirement, not a voluntary annex.
