Data and data governance in the EU
The two acts treat the same matter from opposite ends: the Data Act decides who gets data out of a product or a service, the Data Governance Act organises sharing where data is not free. This page goes through the duties and the roles.

The Data Act
- The user of a connected product is entitled to the data the product generates.
- Data must be shareable onward with a third party the user designates.
- Cloud services must be switchable without charges for the switch itself and with documented transfer.
- Contract terms that unilaterally set the rights aside do not bind.
The Data Governance Act
- Data intermediation services must stay neutral: the intermediary may not use the data for its own account.
- Data altruism requires registration and disclosure of purposes.
- Re-use of protected public-sector data happens on terms that must be open and non-discriminatory.
What it means in procurement
- A contract for a connected product should say who gets which data, and in what format.
- Switching terms belong in the contract, not in a later negotiation.
- The requirements can be checked against the article: every row in the register carries address, reading date and hash.

- Yes, the switching rules are aimed specifically at data processing services. The articles sit in the register with reading date and address.
- Can I fetch the structure of the acts as data?
- Yes. The EU data catalogue gives act, article number, heading, address, hash and citation string free and without a key.
- Do you cover national application?
- We report the national instruments we have read per jurisdiction and mark the rows that are not read yet.
