Frågor om tillstånd enligt 28 a § prövas av länsstyrelsen i det län där det berörda området finns.
För en verksamhet eller åtgärd som omfattas av tillståndsplikt eller dispensprövning till följd av bestämmelserna i 9 kap. eller 11-15 kap. skall dock frågan om tillstånd enligt 28 a § prövas av den myndighet som prövar den andra tillståndsfrågan eller dispensen. Innan myndigheten meddelar sitt beslut, skall den länsstyrelse som avses i första stycket beredas tillfälle att yttra sig. Lag (2001:437).
