  • Artikel 17

    Investigation and duty to provide information

    The competent authority opens an investigation where there is substantiated concern that a product was made with forced labour, following a preliminary assessment weighing risk indicators and submitted information. Economic operators must supply requested supply chain information within the stated deadline, and the authority may run checks outside the union with the state's agreement. Decisions rest on the evidence as a whole.

    Example An authority requests traceability records for cotton yarn from a clothing importer and proceeds when the importer cannot evidence any tier beyond the sewing factory.

    Prohibition, withdrawal and disposal

    Where forced labour is established, the authority prohibits placing and making the product available, orders withdrawal of products already on the market, and orders disposal in the prescribed manner. The decision applies union-wide through mutual recognition. The prohibition can be lifted where the operator shows the forced labour has been eliminated from the chain.

    Example A batch of solar panels is withdrawn in four member states, and the prohibition is lifted only after the importer changes polysilicon supplier and has the new chain audited.
