Federal Trade Commission rule on non-compete clauses
16 CFR Part 910, 89 Fed. Reg. 38342 · Read 2026-08-15
Adopted on 23 April 2024 and set aside nationwide by the Northern District of Texas in Ryan LLC v. FTC on 20 August 2024, so it never took effect. Non-compete clauses are therefore governed by state law and by case by case enforcement, and the Commission has continued to act against individual clauses.
