Hyresnämndsmål. Nödvändig processgemenskap föreligger för hyresvärdar, i detta fall för tomträttshavarna till den fastighet där lägenheten är belägen, vid ansökan om upphörande av hyresavtal. Eftersom endast en av hyresvärdarna var sökande i hyresnämnden och bristen inte kunde läkas i hovrätten undanröjdes hyresnämndens beslut och den enskilde hyresvärdens ansökan i hyresnämnden avvisades.
