Hyresnämndsmål. Hyresgästen omfattades av vård enligt LSS. Sundsvalls kommun, som också var hyresvärd, yrkade att hyresförhållandet skulle upphöra eftersom vården skulle omorganiseras och hyresgästen skulle erbjudas annat boende. Hovrätten ansåg att kommunens intresse av att hyresförhållandet skulle upphöra var beaktansvärt. Mot detta ställdes dock hyresgästens behov av kontinuitet i sitt boende. Hovrätten fann att kommunens intressen fick vika vid intresseavvägningen. Att förvaltningsrätten funnit att kommunen haft skäl att förändra hyresgästens tidigare beviljade insats enligt LSS förändrade inte hovrättens bedömning.
