Förare, vilkens körkort återkallats för viss tid, har under spärrtiden kört bil. Han har dagen för körningen genom stämningsman delgivits länsrättens beslut om återkallelse men underlåtit att före körningen ta del av beslutet. Då föraren inte haft sitt körkort tillgängligt vid delgivningen, har han överenskommit med stämningsmannen att han skulle inlämna körkortet några dagar senare till polisen. Han ansåg sig ha rätt att köra bil intill dess han lämnat från sig körkortet. Eftersom bristande uppsåt ansetts föreligga och straffbarhet vid oaktsamhet inte kunde komma ifråga, har åtal för olovlig körning ogillas.
