Enligt studiestödslagen (1973:349) gällde delvis olika regler för återbetalning av studiemedel och studielån beroende på om låntagaren var bosatt i Sverige eller utomlands. Det har inte ansetts vara förenligt med gemenskapsrätten att vägra låntagare som är bosatta i annat EU-land återbetalning enligt de regler som tillämpas för här bosatta låntagare (I och II).
