Sedan åklagare enligt 27 kap. 4 a § rättegångsbalken har beslutat att ett beslagtaget föremål skulle lämnas ut till målsäganden, har hovrätt vid prövning enligt 27 kap. 6 § andra stycket upphävt beslutet och förpliktat målsäganden att ersätta motparten för dennes rättegångskostnader. Riksåklagarens överklagande i kostnadsdelen med yrkande att motpartens rättegångskostnader skall ersättas av allmänna medel har avvisats, eftersom riksåklagaren inte överklagat för målsägandens räkning och inte ansetts ha egen partsställning i målet.
