Migrationsverket kan i ärenden om överföring enligt Dublinförordningen inte åläggas ett utredningsansvar som innebär att verket måste försäkra sig om att asylsökande inte riskerar att sändas vidare till hemlandet från den stat som är ansvarig för asylprövningen enligt förordningen. En överföring av asylsökande till Italien har vidare inte ansetts strida mot 12 kap. 1 § och 2 § utlänningslagen och artikel 3 i Europakonventionen om mänskliga rättigheter med anledning av asylförfarandet och mottagningsförhållandena i det landet. Med hänsyn till att verkställighet av överföringsbesluten emellertid har bedömts strida mot skyddet för familjelivet i artikel 8 i Europakonventionen, ska prövningen av asylansökningarna ske i Sverige.
