Fråga huvudsakligen om arbetsgivaren därigenom gjort sig skyldig till kollektivavtalsbrott

En arbetstagare hos SVT har skrivit inlägg på Facebook och bl.a. tagit ställning i en fråga som han bevakade inom ramen för sin anställning som reporter och programledare. Med hänvisning till SVT:s public serviceuppdrag förändrade arbetsgivaren arbetstagarens arbetsuppgifter under en viss period och tilldelade honom en erinran. Fråga huvudsakligen om arbetsgivaren därigenom gjort sig skyldig till kollektivavtalsbrott. Arbetsdomstolen har gjort bedömningen att det inte är visat att en åberopad kollektivavtalsbestämmelse innebär en skadeståndssanktionerad ömsesidig lojalitetsplikt. Domstolen har inte heller funnit att SVT agerat i strid med Europakonventionen och god sed på arbetsmarknaden eller i strid med det enskilda anställningsavtalet. Även fråga om del av talan ska avvisas enligt 4 kap. 7 § arbetstvistlagen.
