Vid tillkomsten år 1998 av ett nytt pensionsavtal på det kommunala området uppkom behov av att reglera arbetstagarnas redan intjänade pensionsrätt. Det nya pensionsavtalet, PFA 98, tillfördes bestämmelser om detta vari bl.a. föreskrevs att folkpension och ATP ska bestämmas utifrån de uppgifter bl.a. om civilstånd som gällde för arbetstagaren den 31 december 1997, dvs. dagen före det nya pensionsavtalets ikraftträdande. Tvisten gäller frågan om den regeln innebär att man vid beräkningen av den intjänade pensionsrätten ska likställa en ogift arbetstagare med en gift arbetstagare på samma sätt som enligt reglerna för den allmänna pensionen vid beräkningen av ålderspension.
