En arbetsgivare är inte skyldig att betala ut sjuklön vid sjukdom
1. för sådan tid som arbetstagaren omfattas av bestämmelserna i 37 kap. 3 § socialförsäkringsbalken, eller
2. om arbetstagaren inte helt har återgått i arbete och utfört arbete under minst en dag hos arbetsgivaren efter det att sjuklön för en hel sjuklöneperiod har betalats ut av arbetsgivaren. Lag (2012:349).
