Om tvist har uppkommit om arbetstagarens rätt till sjuklön och tvisten gäller huruvida arbetsförmågan är nedsatt på grund av sjukdom eller nedsättningens omfattning eller huruvida arbetstagarförhållande föreligger, kan Försäkringskassan, efter skriftlig ansökan av en arbetstagare som är försäkrad för sjukpenning enligt socialförsäkringsbalken, besluta att ersättning för tid som den omtvistade sjuklönen avser ska utges av Försäkringskassan. Lag (2010:1248).
