Har en arbetstagare mottagit semesterlön i förskott, minskas semesterersättningen med sådan semesterlön. Detta gäller dock inte, om den semesterlön som togs emot i förskott utbetalades mer än fem år före anställningens upphörande eller om anställningen har upphört på grund av
1. arbetstagarens sjukdom,
2. förhållanden som avses i 4 § tredje stycket lagen (1982:80) om anställningsskydd, eller
3. uppsägning från arbetsgivarens sida som beror på förhållanden som inte hänför sig till arbetstagaren personligen, utom när uppsägning sker i samband med en konkurs. Lag (2009:1439).
