7 kap. 29 §

Trots bestämmelserna i 28 b § får tillstånd enligt 28 a § lämnas, om
1. det saknas alternativa lösningar,
2. verksamheten eller åtgärden måste genomföras av tvingande orsaker som har ett väsentligt allmänintresse och
3. de åtgärder vidtas som behövs för att kompensera för förlorade miljövärden så att syftet med att skydda det berörda området ändå kan tillgodoses.
Ett beslut om tillstånd med stöd av första stycket får lämnas endast efter regeringens tillåtelse. Lag (2001:437).
