I fråga om omgivningsbuller vid en bostadsbyggnad får tillsynsmyndigheten inte besluta om förelägganden eller förbud om det i planbeskrivningen till detaljplanen eller i bygglovet enligt plan- och bygglagen (2010:900) har angetts beräknade bullervärden och omgivningsbullret inte överskrider dessa värden.
Trots första stycket får förelägganden eller förbud beslutas om det med hänsyn till de boendes hälsa finns synnerliga skäl för det.
Förelägganden eller förbud får dock aldrig beslutas i fråga om omgivningsbuller vid sådana komplementbostadshus som avses i plan- och bygglagen. Lag (2025:976).
