Från skatteplikt undantas en sådan överföring från Sverige till ett annat EU-land som enligt 5 kap. 12 § likställs med en leverans av varor mot ersättning under förutsättning att leveransen skulle ha omfattats av undantag från skatteplikt enligt 42 § om den hade gjorts till en annan beskattningsbar person.
