Har en arbetstagare blivit avskedad under omständigheter som inte ens skulle ha räckt till för en giltig uppsägning, ska avskedandet förklaras ogiltigt på yrkande av arbetstagaren.
Vid en tvist om ogiltighet av ett avskedande kan domstol inte för tiden fram till det slutliga avgörandet besluta att anställningen ska bestå. Lag (2022:835).
