Om en arbetstagare sägs upp utan sakliga skäl, ska uppsägningen förklaras ogiltig på yrkande av arbetstagaren. Detta gäller dock inte om uppsägningen angrips endast därför att den strider mot turordningsregler.
Vid en tvist om ogiltighet av en uppsägning kan domstol inte för tiden fram till det slutliga avgörandet besluta att anställningen ska bestå efter uppsägningstidens utgång. Lag (2022:835).
